What we mean by "capacity"

It's really important that we capture this information accurately. Doing this will mean we can offer you a service best suited to your needs; ensuring your wishes are understood and that your estate will be dealt with in the way you want.

You must have testamentary capacity to make a Will. To show you have testamentary capacity you must not be suffering from a disorder of the mind, and you must:

  • Understand what a Will is and the effect it will have
  • Have knowledge of the assets you own that will pass under your Will
  • Be aware of any individuals who could, if not included in your Will, have a claim on your estate.

For example, you can choose not to include a child in your Will however you must be aware they could reasonably be expected to be provided for and their exclusion may result in them bringing a claim against your estate.
